Terms and Conditions
1. Introduction
These Terms and Conditions (the “Terms”) govern (a) the booking and provision of mental performance coaching services (the “Services”), and (b) access to and use of the website available at https://inthepresent.coach/ (the “Website”) including all content, tools and functionalities made available through it (the “Material”).
These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement (the “Agreement”) between the user (“you” or the “Client”) and Ioanna Katsikari (the “Coach”, “we”), with registered business address Athens, Greece, email mp@inthepresent.coach, unless agreed otherwise in writing.
Prior to browsing the Website and making any transaction within it, please ensure that you have thoroughly read the present Terms. By accessing or using the Website and/or booking or using the Services, you acknowledge that you have read, understood and agree to be bound by this Agreement. If you do not agree with these Terms, you are required to abstain from using the Website.
2. Amendments
We may amend at any time these Terms, depending on the services rendered and the way the Website is technically structured and functions. Such amendments will be clearly and noticeably presented in the front page of the Website.
You shall regularly check the Terms. The last update shall be cited in the Terms. Your use of this Website after a change has been posted shall be considered as acceptance of the amended Terms.
3. Description of Services
Τhrough the Website, Ioanna Katsikari (the “Coach”) provides mental performance coaching services to competitive athletes, coaches and teams.
For the purposes of these Terms, “coaching” includes mental performance coaching, personal development services, and, where applicable, group work, tailored to competitive athletes, coaches and teams.
The Services consist of coaching sessions based on structured, questionnaire-led coaching grounded in validated performance-psychology frameworks. The introductory session shall have a duration of forty-five (45) minutes, while each subsequent session shall have a duration of sixty (60) minutes. Sessions may be extended by mutual agreement, subject to the Coach’s availability, and any additional time shall be charged on a pro rata basis.
In this context, the Coach may use validated assessment tools and questionnaires to provide tailored guidance aimed at enhancing mental performance.
4. Coaching Disclaimer
a. You acknowledge, understand and agree that:
- The Services are coaching services only and are not offered as, and shall not be interpreted as, medical, psychological or psychiatric advice or treatment, psychotherapy, psychoanalysis, mental health care or any other healthcare service.
- The Services are not offered as, and are not intended to, diagnose, provide a prognosis for, treat, cure or recommend any treatment for, any medical, physical or mental health condition. The Coach does not prescribe, recommend or advise on any medicinal product, dietary supplement or other healthcare intervention.
- The Coach is not a licensed physician, psychologist, psychiatrist, psychotherapist or other healthcare professional and is not acting as such. No physician-patient, psychologist-client, psychotherapist-patient or other healthcare professional relationship is created through the provision of the Services.
- The Coach has been recognized and/or certified by the International Coaching Federation (ICF) as a professional coach. Such recognition and/or certification relates solely to coaching and does not qualify or authorize the Coach to provide healthcare services.
- You are fully responsible for your well-being during and after the provision of the Services, including your choices, decisions and actions, and for obtaining such medical, psychological, psychiatric or other professional advice as may be appropriate to your circumstances. Where you have, suspect that you may have, or develop a physical or mental health condition, you should seek advice from an appropriately qualified healthcare professional and should not disregard, delay or discontinue any treatment, therapy or healthcare service on the basis of the Services.
- The Coach reserves the right to refuse, suspend or terminate the provision of the Services where the Coach reasonably considers that your needs fall outside the scope of coaching or would be more appropriately addressed by a physician, psychologist, psychiatrist, psychotherapist or other qualified healthcare professional.
- All assessments, questionnaires, observations, comments, ideas, exercises, tools, materials, recommendations and guidance provided by the Coach are provided solely for the purpose of supporting you in achieving the goals identified by you during the coaching process. Such content must not be relied upon as, or considered to constitute, medical, psychological, psychiatric or other healthcare advice.
- To the extent that the Services involve personal development, mental performance, career or business-related objectives, the Coach does not promise or guarantee any particular outcome, including, without limitation, mental performance enhancement, personal introspection, increased personal happiness, career progression, profitability and/or business success.
- The Services are not intended as a substitute for emergency medical care and are not appropriate in situations requiring immediate medical, psychological or psychiatric intervention. In such cases, you should immediately seek assistance and consult a physician or other, appropriately qualified, healthcare professional. In case of an emergency, call 166 or any other applicable emergency services number immediately.
- The information contained on the Website, including data, images, tools, and other materials, is intended for general informational purposes. Such information should be used as a reference only and not as a comprehensive source. While the Coach strives to ensure that the information available on the Website is accurate, complete, reliable and up to date, it is provided for general informational purposes only and should not be relied upon as professional, medical, psychological, psychiatric or other healthcare advice.
5. Coaching session Booking
a. To book your initial coaching session, you must select your preferred date and time through the Calendly application available on our Website. The Coach agrees to maintain her availability to match that presented by the Website, and to honour the sessions booked through the online booking’s app. You can book your coaching session by providing your name and email address to the Calendly application. Session booking is permitted only to individuals who are at least eighteen (18) years of age.
b. Following the confirmation of your booking and payment of the applicable fee, the Coach will provide you with a secure electronic link, sent via email, to access the session through Google Meet. You are responsible for ensuring access to a suitable device (computer or smartphone) and a stable internet connection in order to attend the session. The Coach is responsible for initiating and concluding each session.
c. Following your initial session and subject to mutual agreement on the continuation of coaching services, you will be requested by the Coach to register as a user on the Website and create a username and password in order to book and attend any subsequent sessions. The process for attending subsequent sessions shall remain the same.
6. Account & Passwords
a. The account password you create should be unique and kept secure, and you must notify us immediately of any breach of security or unauthorized use of your account or such possibility that comes to your attention. You are strictly responsible for all the actions made under your personal password and username and your account in general. The Coach is not responsible for any harm or damage that may occur from unauthorized use of your account due to non-compliance with this clause.
b. Your account is personal to you and may not be shared, transferred, or made available to any third party. You agree to use the Website and your account only for lawful purposes and in accordance with these Terms.
c. You can deactivate your account at any time by sending us an e-mail at mp@inthepresent.coach. All information and content that has already been provided to us will be handled according to our Privacy Policy.
d. If we have reason to believe that the information provided by you while registering and using any of the services provided infringed these Terms, the Coach may, at her sole discretion, take any action deemed appropriate, including deactivating your Account.
e. In order to create an account or make purchases on the Website you will be required to provide your personal details. Please ensure that any personal details provided are true, complete, up to date and accurate, and inform us immediately at the e-mail address indicated above of any changes to the details you provided when registering.
7. Your obligations and agreements
You acknowledge and agree that:
- all information you provide is true, correct, accurate, current and up-to-date;
- you will be accessible on your email provided to us by you at the time arranged for your coaching session;
- you will notify us of any delays;
- if you are not on time for a coaching session, your session time will have to be reduced, but the full session fee will still apply.
8. Fees/Payments
a. All fees for the Services are stated in EUR and are inclusive of applicable taxes. The applicable fee will be confirmed upon completion of the introductory call.
b. Applicable fees for coaching sessions may be paid on a per-session basis or in pre-agreed bundles of sessions, subject to prior agreement with the Coach, and are payable upfront.
c. Bundled sessions must be used within three (3) months from the date of purchase, failing which any unused sessions may be forfeited without refund.
d. Bundle fees are non-transferable and may not be assigned to another person without the Coach’s prior written consent.
e. The Coach reserves the right to amend the applicable fees at any time. Any changes to fees will not affect sessions already booked and paid for but will apply to any future bookings or renewals.
f. Fees may be paid online by debit or credit card, or via PayPal, using the payment gateway linked to the “Calendly” booking platform. Alternatively, payment may be made by standing order or bank transfer. For in-person coaching sessions, payment may also be made in cash, subject to prior agreement. Invoices will be issued by email.
9. Cancellations, Rescheduling and Refunds
a. If you need to cancel or reschedule a coaching session, you need to provide the Coach at least forty-eight (48) hours’ prior notice.
b. Cancellations made less than forty-eight (48) hours before the scheduled session time will be treated as late cancellations and are not eligible for a refund.
c. Where a cancellation is made at least forty-eight (48) hours in advance, you are entitled to a full refund or a rescheduled session. Refunds will be processed without undue delay and, in any event, within fourteen (14) days from the date on which the Coach is notified of the cancellation. All refunds will be issued using the same payment method originally used for the purchase of the Services, unless otherwise agreed.
d. Where a session is rescheduled in accordance with these Terms, the rescheduled session must take place within a reasonable time period, subject to the Coach’s availability.
e. A rescheduled session may not be cancelled and rebooked more than once, unless otherwise agreed with the Coach. If you fail to attend a rescheduled session, or request a further rescheduling without the Coach’s prior agreement, the session shall be deemed forfeited and no refund shall be provided.
f. Rescheduling is subject to the notice requirements set out above and does not give rise to any additional refund rights beyond those expressly provided in these Terms.
g. The Coach reserves the right to cancel or reschedule a booked session in exceptional circumstances. In such cases, the Coach shall provide you with as much prior notice as reasonably practicable and will offer an alternative date and time for the session at no additional cost. Where rescheduling is not feasible or acceptable to you, you shall be entitled to a full refund of any fees paid in respect of the affected session.
10. Confidentiality
Personal or business information provided by clients during coaching sessions will be treated as strictly confidential and will only be disclosed where required by law.
11. Liability
a. Nothing in these Terms shall exclude or limit any liability which cannot be excluded or limited under applicable law.
b. We shall be liable only for willful misconduct or gross negligence, and to the extent that such liability can be established under applicable law.
c. Subject to the foregoing, we shall not be liable for any indirect or consequential losses, including, without limitation, loss of profits, loss of business, business interruption or loss of opportunity. Any liability arising in connection with these Terms or the provision of the Services shall in all cases be limited to the total fees paid by you for the relevant Services giving rise to the claim, and shall extend only to losses that were reasonably foreseeable at the time of booking. Losses are foreseeable where they could be contemplated at the time your booking is accepted.
d. We will not be liable or responsible for any failure to perform, or delay in performance of, any of the obligations under these terms, that is caused by events outside of the Coach’s reasonable control.
e. We shall not be liable in any way, directly or indirectly, for any loss, harm or damage (whether direct or indirect) suffered by third parties due to your activity on the Website which are in violation of the provisions of these terms and/or applicable law. We reserve our rights against such third parties, including the right to commence legal proceedings.
f. You agree to compensate us for any direct losses or damages we suffer as a direct result of your intentional or fraudulent misuse of the Website or your deliberate violation of applicable law.
g. The Website is provided on an "as is" and "as available" basis. You may not modify, interfere with, or otherwise intervene in the operation of the Website. The Coach reserves the right to suspend, restrict, or terminate your access to the Website or parts of it as well as to change, edit or delete its content at any time, for any reason and without notice.
h. Further, to the fullest extent permitted by applicable law, no warranty is given that the Website, any page or any content shall be fault free, secure and available on an uninterrupted basis, and no liability can be accepted in respect of losses or damages arising out of such failures and unavailability.
i. Whilst we have taken all reasonable steps to ensure the accuracy, reliability and completeness of the information on this Website, we give no warranty and make no representation regarding the accuracy or completeness of the content of this Website. We reserve the right to change or update information without prior notice at any time.
j. Access to and use of this Website is at your own risk and, to the fullest extent permitted by applicable law, we do not warrant that the use of this Website or any material downloaded from it will not cause damage to any property, including but not limited to loss of data or computer virus infection. We accept no liability for such instances. You are recommended to take all appropriate safeguards (such as installing appropriate anti-virus software) and firewalls before downloading information or images from the Website.
k. Except as expressly provided in these Terms, we exclude all representations, conditions and warranties, whether express or implied (by statute or otherwise), to the fullest extent permitted by law.
l. We do not seek to exclude or limit our liability to you for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability, such as death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; liability under consumer protection law.
12. Links to third party websites and restrictions
a. Links to third party websites are placed in our Website for your convenience, thus however we bear no liability for the content or functionality thereof. The use of third party websites is entirely at your own risk.
b. These Terms do not apply to any third party website linked to the Website. You should read the terms and conditions of those websites before using them and direct any questions or comments about their contents to the relevant website provider.
c. You are not entitled (nor will you assist others) to set up links to the Website (whether by hypertext linking, deep-linking, framing, toggling or otherwise), nor may you frame the Website on a third party website, without our prior written permission, which we may grant or withhold at our absolute discretion.
d. You agree that when accessing the Website you shall not price scrape or harvest pricing either manually or by use of a web spider, web robot or any other web crawling or other technology.
e. You must not attempt to gain unauthorized access to the Website, or our servers, or any hardware supporting the Website. Nor must you attempt to reconfigure the Website in any way.
f. You must not misuse the Website in any manner, including through viruses, malware or any other material that may be technologically harmful or malicious.
13. Intellectual Property Rights
a. The Website, including its software, as well as the Material and its arrangement, including but not limited to, graphics, images, texts, photographs, trademarks, logos and distinctive signs, whether registrable or not, constitute the intellectual and/or industrial property (collectively referred to as “Intellectual Property” or “IP”) of the Coach or, where applicable, of her suppliers and/or licensors, and is protected by the relevant provisions of Greek, EU, and international law governing the protection of IP.
b. Nothing herein grants you any ownership rights in relation to the IP of the Coach and/or of any third parties, except as expressly provided for in these Terms. The Coach, her suppliers and/or licensors expressly reserve and retain all IP and/or any other rights and interests in and to their IP.
c. Provided that you comply with the Terms, the Coach grants you a free, limited, non-exclusive, non-transferable license to access the Website and its Material on your device, and to use it only for the purposes specified in these Terms.
d. In this context, you may only download a copy and/or store a copy of the Material strictly for personal use and for non-commercial purposes, without removing any indication of its source/origin, and provided that all proprietary or other rights of the Coach and/or third parties are not violated in any way.
e. Except for the expressly permitted uses, the Website and the Material may not be reproduced, copied, leased, sold, sub-licensed, assigned, transferred, exported, transmitted, retransmitted or distributed in whole or in part by you. Likewise, to the maximum extent permitted by law, decompilation, reverse engineering or any attempt to obtain the source code of the Website is prohibited.
f. If you believe that the Website and/or the Material violates in any way any IP rights, you may notify the Coach by email at mp@inthepresent.coach, identifying the infringing content and explaining the reasons of the alleged infringement, so that the claims can be reviewed and any infringing content can be removed from the Website.
14. Miscellaneous
a. Force Majeure: Where there is a Force Majeure Event, we will not be considered in breach of this Agreement, to the extent that our obligations and/or the Services provided via our Website are unable to be performed by such an event. We will not incur any liability to you for any Loss or Damage of any nature incurred or suffered in connection with any Force Majeure Event.
b. Governing Law and Jurisdiction: These Terms are governed by the laws of Greece. Both parties agree to unconditionally submit to the non-exclusive jurisdiction of the courts of Athens for determining any dispute concerning this Agreement.
c. Severability: If any provision of these Terms is found to be invalid or unenforceable by a court, it will be severed from the rest of these Terms, which shall remain valid and in effect.
d. Personal Data Protection: Personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679, Greek Law 4624/2019 and Greek Law 3471/2006. Further details are provided in the Privacy Policy.
